What do oilfield service contractors in Midland need from their insurance?

Updated . Sources for every claim are listed at the end.

The short version

  • Midland County is in Railroad Commission District 08, and the District 08 office is in Midland. In the RRC's July 2026 figures, District 08 issued 275 permits to drill new holes, more than any other district in Texas.
  • The work around Midland is Midland Basin Spraberry and Wolfcamp. The UT Bureau of Economic Geology describes Wolfberry completions spanning a vertical interval between 6,000 and 10,000 feet.
  • The RRC's Gardendale Seismic Response Area includes part of Midland County, and the RRC suspended deep produced water disposal there in December 2021. That changes where water goes and how far your trucks drive.
  • Midland is where many MSAs are signed. The insurance exhibit you agree to here usually follows your crews into every county and across the New Mexico line.

Midland in Railroad Commission terms

Midland County is in RRC District 08. The District 08 office is in Midland at 10 Desta Drive, and it covers 20 counties, including Andrews, Ector, Howard, Martin, Midland, Reeves, Ward and Winkler.

The Texas State Historical Association calls Midland the "administrative center of the huge Permian Basin petroleum fields." Oil strikes in Reagan County in 1923 and Ector County in 1926 turned Midland into a headquarters town for oil companies, and the 1947 Midland South pool helped establish the basin's reputation.

The volume difference between Permian districts is large. In the RRC's July 2026 statistics, District 08 had more permits and more new oil completions than any other district in the state.

Spraberry, Wolfcamp and stacked completions

The RRC describes the Midland Basin as Spraberry and Wolfcamp country, with the two often produced together as the "Wolfberry." The UT Bureau of Economic Geology says the Spraberry and Dean sandstones have produced oil in the Midland Basin since the late 1940s, that the Spraberry Trend's productive areas cover 18 counties including Midland, and that Wolfberry completions span a 4,000-foot interval between 6,000 and 10,000 feet below the surface. BEG counts more than 5,800 Wolfberry oil wells completed since the late 1990s.

For a service contractor, deep stacked completions mean more time with your tools and people in the hole and around high-pressure equipment. The questions that matter in a Midland MSA:

Workover rigs, hot oil units and flowback crews all live in this exposure. See well servicing insurance and hot oil insurance.

Produced water and the Gardendale seismic response area

The RRC lists the Gardendale Seismic Response Area in Ector, Martin and Midland counties. In December 2021 it suspended permits for 33 deep disposal wells there, stating that it was "suspending all disposal well permits to inject oil and gas waste into deep strata." An operator-led plan from May 2023 states that "all deep disposal within the SRA will remain shut in."

On December 16, 2022, a magnitude 5.4 earthquake struck about a dozen miles north of Midland in Martin County, inside the SRA. The RRC sent inspectors to examine disposal activity at nearby injection wells.

What this means for a Midland water hauler or SWD contractor:

  • Different disposal destinations. When deep disposal is shut in, water goes somewhere else. Longer routes mean more miles, and more miles are more auto exposure.
  • Permits. Hauling non-hazardous oil and gas waste, including produced water, for hire off the lease where it was generated requires an RRC waste hauler permit. You need an active Form P-5 first, and the permit renews every year.
  • Pollution coverage. A spill while loading, on the road, or while unloading at a disposal site can fall between your auto and GL policies. See do I need pollution coverage to haul produced water and oilfield pollution liability.

SRA boundaries and limits change. Check the RRC's seismicity response page for the current rules before you plan routes.

Moving rigs and well service units out of Midland yards

Interstate 20 crosses the northeast corner of Midland County and State Highway 349 runs north and south through it. A lot of well servicing equipment leaves Midland yards on those roads.

State permits. The Texas Department of Motor Vehicles issues oversize and overweight permits, and Transportation Code 623.142 provides a permit for fixed-load mobile machinery used to service, clean out or drill an oil well, for movement over roads under the jurisdiction of the Texas Department of Transportation. TxDMV also offers an annual oil well servicing unit permit. For that permit:

  • the unit needs a Texas permit plate,
  • you must provide a USDOT number, which TxDMV checks against federal out-of-service records,
  • the permit is issued to the company name listed for that USDOT number, and
  • you are responsible for routing and current restrictions.

County roads. Under Transportation Code 621.301, a commissioners court can set load limits on county roads and bridges with TxDOT's concurrence. A vehicle operating under a 623.142 oil well machinery permit may operate under the permit's conditions on those roads.

The insurance tie-in. The company name on your USDOT number and TxDMV permit should match the named insured on your auto policy and the entity that signed the MSA. A mismatch is the kind of thing that gets a certificate questioned. See do oilfield trucks need a USDOT number and oilfield auto insurance and MCS-90.

Midland is where the MSA gets negotiated

Because so many operators run their Permian business from Midland, this is where you are most likely to receive the master service agreement and its insurance exhibit. That exhibit usually covers every job you do for that operator, wherever the well is.

What we read first in a Midland MSA:

  • Indemnity and Chapter 127. Texas voids indemnity for the other party's own negligence on well work unless the parties agree in writing that it will be supported by insurance. For mutual indemnity, the obligation is limited to the coverage and dollar limits each side agreed to carry, so the limits in the exhibit become your indemnity. See Texas oilfield anti-indemnity act and knock-for-knock indemnity.
  • Additional insured, waiver and primary wording. Whether your GL, auto, umbrella and workers' comp endorsements match what the exhibit asks for. See what is a blanket additional insured endorsement.
  • New Mexico. If the MSA also covers New Mexico wells, your workers' comp and indemnity setup need to account for it. See the Permian Basin guide.
  • H2S training records. Rule 36 requires operators in covered areas to get written certification from service companies that their people were trained. Operators often collect it through ISNetworld or Avetta.

Common questions

Which RRC office handles Midland County?

Midland County is in District 08. The District 08 office is in Midland at 10 Desta Drive, Suite 500 E.

Can produced water still go to deep disposal wells near Midland?

Not inside the Gardendale Seismic Response Area. The RRC suspended deep disposal permits there in December 2021, and the 2023 operator plan keeps deep disposal shut in. Check the RRC seismicity response page for current boundaries.

Do I need an RRC permit to haul produced water out of Midland County?

If you haul non-hazardous oil and gas waste, including produced water, for hire off the lease where it was generated, you need an RRC waste hauler permit. It requires an active P-5 and renews annually.

Does my well service unit need a TxDMV permit?

Oversize or overweight units need a TxDMV permit. TxDMV offers an annual oil well servicing unit permit, which requires a Texas permit plate and a USDOT number in your company name.
